INSTALLATION AND WARRANTY

 

Critical Safety Component Terms, Risk Disclosure, Warranty Limits and Liability

Allocation

IMPORTANT LEGAL NOTICE: READ CAREFULLY BEFORE PURCHASING, ORDERING,

RECEIVING, INSTALLING, FITTING, MODIFYING, TESTING, DRIVING WITH,

RESELLING, OR OTHERWISE USING ANY LPSR PRODUCT.

These Terms and Conditions apply to all products supplied by LPSR PTY LTD ABN 97 642 645 798, trading as LPSR Lucas Power Steering Racks, including but not limited to power steering racks, steering rack assemblies, reconditioned steering racks, seal kits, tie rods, boots, steering linkages,conversion components, hydraulic steering components, related fittings, ancillary components, replacement parts, and any associated goods, documentation, technical information, or instructions supplied by LPSR Lucas Power Steering Racks.

By purchasing, ordering, accepting delivery of, installing, fitting, commissioning, using,

reselling, transferring, or permitting another person to use any LPSR product, you confirm that you have read, understood, accepted, and agreed to be legally bound by these Terms.

If you do not agree with these Terms, you must not purchase, install, fit, use, resell, transfer, or allow any person to use the product.

These Terms are intended to apply to the maximum extent permitted by law. Nothing in

these Terms excludes, restricts, or modifies any non-excludable rights, guarantees,

remedies, or protections available under the Australian Consumer Law or any other

mandatory law that cannot lawfully be excluded.

 

1. Definitions

In these Terms:

ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and

Consumer Act 2010.

Customer, you, or your means the purchaser, installer, end user, reseller, distributor,

mechanic, repairer, workshop, fleet operator, vehicle owner, or any person who receives, installs, fits, uses, resells, or handles a Product.

LPSR Lucas Power Steering Racks, we, us, or our means LPSR Pty Ltd ABN 97 642 645 798, its directors, officers, employees, contractors, suppliers, agents, related entities, successors, and assigns.

Product or Products means any steering rack, reconditioned steering rack, seal kit, tie rod, boot, conversion component, power steering component, hydraulic component, replacement part, accessory, fitting, documentation, or related item supplied by LPSR Lucas Power Steering Racks.

Vehicle means any car, commercial vehicle, truck, modified vehicle, race vehicle, off-road vehicle, imported vehicle, rebuilt vehicle, written-off vehicle, repaired vehicle, or other motor vehicle into which a Product is installed or intended to be installed.

Qualified Installer means a properly licensed, trained, competent, insured, and experienced automotive mechanic, steering specialist, engineer, repairer, or workshop legally authorised in the relevant jurisdiction to install safety-critical steering components.
 

2. Safety-Critical Product Warning

You expressly acknowledge and agree that:

1. LPSR Lucas Power Steering Racks Products are safety-critical steering components.

2. A Product failure, incorrect installation, incorrect fitment, contamination, misuse,

modification, incorrect bleeding, incorrect torqueing, faulty related components,

improper maintenance, or continued use after warning symptoms may result in:

o sudden or progressive steering failure;

o partial or complete loss of steering control;

o vehicle crash;

o serious personal injury;

o death;

o damage to the Vehicle;

o damage to third-party property;

o injury or death to third parties.

3. Steering systems must be treated as high-risk mechanical systems requiring

professional expertise.

4. No Product should be installed, adjusted, modified, tested, or used by any person

who is not competent to work on safety-critical steering components.

5. You accept that the safety of a steering component depends not only on the Product

itself, but also on:

o correct product selection;

o correct vehicle identification;

o correct installation;

o condition of the Vehicle;

o condition of connected components;

o hydraulic system cleanliness;

o pump condition;

o hose condition;

o fluid condition;

o steering column condition;

o steering linkage condition;

o steering rack condition;

o suspension and wheel alignment;

o correct bleeding procedures;

o roadworthiness certification;

o ongoing maintenance;

o driving conditions and usage.

6. You have been clearly warned that misuse, incorrect installation, continued use after

symptoms, or failure to follow these Terms can have catastrophic consequences.

 

3. Acceptance of Risk

To the maximum extent permitted by law, you accept all ordinary, obvious, inherent, and

reasonably foreseeable risks associated with purchasing, installing, using, maintaining,

modifying, testing, or driving a Vehicle fitted with a Product.

You acknowledge that LPSR cannot control:

1. the condition of your Vehicle;

2. the skill or competence of the installer;

3. whether the Product is installed correctly;

4. whether all related components are safe and compatible;

5. whether the Vehicle has been modified;

6. whether the Product has been contaminated;

7. whether the Product has been used beyond normal road use;

8. whether post-installation checks have been performed;

9. whether the Vehicle is driven despite symptoms of steering malfunction.

You agree that these matters are outside LPSR’s direct control and that responsibility for

them rests with the Customer, installer, mechanic, workshop, vehicle owner, and/or end user.
 

4. Product Selection, Compatibility and Fitment Responsibility

You are solely responsible for ensuring that the Product is suitable, compatible, and correct for your Vehicle.

Before purchase, installation, or use, you must verify:

1. Vehicle make, model, year, variant, chassis number, VIN, engine type, steering type,

and any relevant build information;

2. whether the Vehicle has been modified, imported, converted, repaired, rebuilt, or

altered from factory specifications;

3. whether the Product is appropriate for the Vehicle’s intended use;

4. whether related components are compatible and in safe working condition;

5. whether additional components, adjustments, programming, engineering approval, or certification are required.

 

Any product listings, photos, descriptions, compatibility charts, website information,

recommendations, or communications are general only and must not be treated as a

substitute for professional inspection and verification.

LPSR is not responsible for incorrect product selection caused by:

1. incorrect information supplied by you or a third party;

2. incomplete vehicle details;

3. vehicle modifications;

4. undocumented changes to the Vehicle;

5. manufacturer variations;

6. aftermarket conversions;

7. assumptions made by the Customer, installer, or mechanic.

 

5. Mandatory Professional Installation

Installation of any LPSR Lucas Power Steering Racks Product must be carried out only by a Qualified Installer.

The Qualified Installer must:

1. inspect the Product before installation;

2. verify compatibility before installation;

3. inspect all connected steering, suspension, hydraulic, and mounting components;

4. follow all manufacturer procedures, torque specifications, alignment procedures, fluid specifications, bleeding procedures, safety standards, and applicable roadworthiness requirements;

5. use clean, correct, uncontaminated fluid;

6. flush the system where required;

7. replace contaminated, damaged, worn, degraded, or unsafe connected components;

8. ensure the Product is not forced, modified, hammered, bent, cut, welded, drilled, re-

threaded, or altered;

9. complete all post-installation testing;

10. ensure the Vehicle is safe and roadworthy before being driven.

DIY installation is strictly prohibited.

Installation by an unlicensed, unqualified, uninsured, or inexperienced person is strictly

prohibited.

Any installation that does not strictly comply with this clause voids all warranties and

transfers all resulting risk to the Customer, installer, vehicle owner, and/or end user to the maximum extent permitted by law.

 

6. Mandatory Inspection Before Installation

Before installation, you and/or the installer must inspect the Product for:

1. visible damage;

2. transport damage;

3. missing parts;

4. incorrect part supply;

5. signs of contamination;

6. physical distortion;

7. incorrect fittings;

8. incorrect threads;

9. oil leaks;

10. manufacturing or reconditioning irregularities.

If there is any doubt, the Product must not be installed.

You must immediately notify LPSR Lucas Power Steering Racks in writing before installation.

Installation of a visibly damaged, incorrect, incomplete, or questionable Product is deemed acceptance that the Product was fit for installation and that any later issue may have been caused by installation, use, vehicle condition, contamination, or external factors.

 

7. Roadworthiness, Engineering Approval and Post-Installation Certification

Immediately after installation, and before the Vehicle is returned to road use, the Vehicle must be inspected, tested, and certified as roadworthy by a Qualified Installer or other competent authority recognised in the relevant jurisdiction.

Where required by law, engineering approval, modification certification, roadworthy

certification, compliance approval, or inspection by an authorised certifier must be obtained.

You must retain written records of:

1. installer identity and licence details;

2. installation date;

3. odometer reading at installation;

4. Product details;

5. proof of purchase;

6. installation invoice;

7. roadworthy certificate;

8. engineering certificate, where applicable;

9. wheel alignment report;

10. fluid flush records;

11. maintenance records;

12. photographs of installation, where available.

Failure to retain and produce these documents upon request may result in rejection of any warranty or claim to the maximum extent permitted by law.

 

8. No Use Until Fully Tested

The Vehicle must not be driven on public roads until:

1. installation has been completed by a Qualified Installer;

2. steering operation has been tested;

3. the hydraulic or electric steering system has been properly bled and checked;

4. there are no leaks, noises, abnormal resistance, binding, play, vibration, stiffness,

warning lights, or steering irregularities;

5. wheel alignment has been completed where required;

6. the Vehicle has passed all required safety inspections.

If any abnormal symptom occurs, use of the Vehicle must cease immediately.

Continued driving after any warning sign is at the Customer’s sole risk.

 

9. Customer’s Continuing Maintenance Obligations

After installation, you must ensure that the Product and Vehicle are properly inspected and maintained.

You must immediately stop using the Vehicle and obtain professional inspection if you

notice:

1. steering stiffness;

2. loss of power assistance;

3. noise when turning;

4. fluid leakage;

5. steering play;

6. knocking;

7. vibration;

8. steering wheel not returning correctly;

9. warning lights;

10. unusual tyre wear;

11. fluid contamination;

12. changes in steering behaviour;

13. any symptom suggesting malfunction.

You must not ignore symptoms.

You must not continue driving in the hope that symptoms will resolve.

Failure to stop using the Vehicle after warning signs may void warranty rights and may

constitute misuse.

 

10. Strict Prohibition on Misuse

The Products are supplied for normal lawful road use only unless LPSR expressly agrees

otherwise in writing.

The warranty and any liability of LPSR are excluded to the maximum extent permitted by law where the Product has been used in connection with:

1. racing;

2. drifting;

3. rallying;

4. motorsport;

5. track days;

6. burnouts;

7. off-road use;

8. commercial overloading;

9. towing beyond manufacturer limits;

10. police, emergency, mining, agricultural, military, or extreme-duty use unless

expressly approved;

11. modified suspension;

12. altered steering geometry;

13. lifted or lowered vehicles;

14. oversized wheels or tyres;

15. collision-damaged vehicles;

16. written-off or repaired vehicles;

17. contaminated hydraulic systems;

18. incorrect fluid;

19. non-approved modifications;

20. negligent, reckless, abusive, or unlawful driving.

 

11. Modification Voidance

You must not modify, alter, dismantle, repair, weld, bend, machine, cut, paint over

identification markings, re-thread, adapt, or interfere with any Product unless LPSR Lucas Power Steering Racks gives written approval.

Any unauthorised modification immediately voids the warranty and transfers all risk to the Customer, installer, vehicle owner, and end user to the maximum extent permitted by law.

 

12. Core Returns and Exchange Components

Where a Product is supplied on an exchange, reconditioned, or core-return basis:

1. you must return the correct exchange unit within the timeframe specified by LPSR;

2. the returned core must be complete, genuine, rebuildable, and not cracked, broken,

bent, fire-damaged, corroded beyond repair, stripped, modified, or missing critical

parts;

3. LPSR may reject any unsuitable core;

4. additional core charges, deposits, or replacement costs may apply;

5. ownership of returned core components passes to LPSR upon receipt unless

otherwise agreed in writing.

LPSR Lucas Power Steering Racks is not responsible for delays, losses, or freight issues relating to return cores unless caused directly by LPSR.

 

13. Freight, Delivery and Transit Risk

Unless otherwise required by law:

1. risk in the Product passes to the Customer upon dispatch from LPSR’s premises or

warehouse;

2. delivery times are estimates only;

3. LPSR is not liable for delays caused by carriers, customs, weather, strikes, border

controls, incorrect addresses, failed delivery attempts, or other events outside

LPSR’s control;

4. you must inspect all deliveries immediately upon receipt;

5. transport damage must be reported in writing within 48 hours of delivery with

photographs and packaging evidence;

6. failure to report transport damage promptly may result in rejection of a freight

damage claim.

 

14. Limited Warranty

Subject to the ACL and any non-excludable law, LPSR provides the following limited

warranty.

 

The Product is warranted against defects in materials and workmanship for:

12 months or 20,000 kilometres from the date of dispatch, whichever occurs first.

This warranty applies only where:

1. the Product was installed by a Qualified Installer;

2. the Vehicle was inspected and certified as roadworthy after installation;

3. all related systems were clean, compatible, safe, and correctly maintained;

4. correct fluid and procedures were used;

5. installation records are available;

6. the Product has been used only for normal lawful road use;

7. the Product has not been misused, modified, contaminated, overloaded, damaged, or neglected.

 

15. Warranty Remedy

Where LPSR Lucas Power Steering Racks accepts a valid warranty claim, LPSR Lucas Power Steering Racks may, at its sole discretion and subject to applicable law:

1. repair the Product;

2. replace the Product;

3. supply an equivalent Product;

4. refund the purchase price of the Product.

To the maximum extent permitted by law, this is the sole remedy available under the

warranty.

Unless required by law, LPSR does not cover:

1. labour costs;

2. removal costs;

3. installation costs;

4. diagnostic costs;

5. towing;

6. hire car costs;

7. accommodation;

8. loss of use;

9. vehicle downtime;

10. lost income;

11. lost profits;

12. missed work;

13. third-party repair costs;

14. consequential loss;

15. inconvenience;

16. storage fees;

17. freight costs unless expressly approved;

18. damage to other components;

19. customer-supplied parts;

20. unauthorised repairs.

 

16. Warranty Exclusions

The warranty does not apply where any issue is caused or contributed to by:

1. incorrect installation;

2. DIY installation;

3. installation by an unqualified person;

4. failure to follow instructions;

5. failure to flush the system;

6. contamination;

7. incorrect fluid;

8. pump failure;

9. hose failure;

10. blocked lines;

11. damaged steering column;

12. worn suspension components;

13. wheel alignment issues;

14. accident damage;

15. impact damage;

16. racing, drifting, track, or off-road use;

17. vehicle modification;

18. misuse or abuse;

19. continued driving after symptoms;

20. normal wear and tear;

21. corrosion;

22. fire or flood damage;

23. incorrect product selection;

24. external leaks from unrelated parts;

25. tampering;

26. unauthorised repairs;

27. failure to maintain the Vehicle;

28. failure to provide installation and maintenance records.

 

17. Warranty Claim Procedure

To make a warranty claim, you must:

1. notify LPSR Lucas Power Steering Racks in writing immediately after discovering the issue;

2. stop using the Vehicle immediately;

3. provide proof of purchase;

4. provide installation invoice and installer details;

5. provide odometer reading at installation and at failure;

6. provide maintenance records;

7. provide roadworthy or certification records;

8. provide photographs and videos where requested;

9. provide a written fault description;

10. return the Product to LPSR Lucas Power Steering Racks if requested.

You must not dismantle, modify, repair, discard, or continue using the Product after an

alleged fault arises unless LPSR Lucas Power Steering Racks authorises this in writing.

Failure to preserve the Product for inspection may result in denial of the claim to the

maximum extent permitted by law.

 

18. Assessment of Claims

LPSR Lucas Power Steering Racks may inspect, test, dismantle, or obtain expert assessment of any returned Product.

You acknowledge that not every steering issue is caused by the Product.

A steering issue may be caused by vehicle condition, installation error, contamination, pump failure, hose failure, improper fluid, alignment issues, worn suspension, accident damage, or other external causes.

If LPSR Lucas Power Steering Racks determines that the issue is not covered by warranty, you may be responsible for inspection, freight, storage, repair, replacement, and return costs.

 

19. No Admission by Inspection or Assistance

Any inspection, communication, technical assistance, goodwill replacement, troubleshooting, advice, or investigation by LPSR Lucas Power Steering Racks does not constitute:

1. admission of fault;

2. admission of liability;

3. waiver of these Terms;

4. acceptance of a warranty claim;

5. acceptance that the Product caused any loss.

 

20. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right,

remedy, or protection under the ACL or any other law that cannot lawfully be excluded.

Where you are a consumer under the ACL, our goods come with guarantees that cannot be excluded under the ACL.

You are entitled to a replacement or refund for a major failure and compensation for any

other reasonably foreseeable loss or damage where required by the ACL.

You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable

quality and the failure does not amount to a major failure.

However, to the maximum extent permitted by law, where the goods are not of a kind

ordinarily acquired for personal, domestic, or household use or consumption, LPSR Lucas Power Steering Racks limits its liability to one or more of the following:

1. replacement of the goods;

2. supply of equivalent goods;

3. repair of the goods;

4. payment of the cost of replacing the goods;

5. payment of the cost of acquiring equivalent goods;

6. payment of the cost of having the goods repaired.

Nothing in this clause limits rights that cannot lawfully be limited.

 

21. Exclusion of Implied Terms

Subject to the ACL and any non-excludable law, all implied warranties, conditions,

representations, guarantees, or terms are excluded to the maximum extent permitted by law.

Without limiting the above, LPSR Lucas Power Steering Racks does not warrant that:

 

1. a Product will be suitable for any particular purpose unless expressly confirmed in

writing;

2. a Product will be compatible with a modified Vehicle;

3. a Product will restore a Vehicle to factory condition;

4. a Product will perform identically to a new genuine OEM component;

5. a Product will be suitable for motorsport, commercial, extreme-duty, modified, or non-standard use;

6. installation of the Product will resolve all steering issues.

 

22. Limitation of Liability

To the maximum extent permitted by law, LPSR Lucas Power Steering Racks is not liable for:

1. personal injury;

2. death;

3. property damage;

4. vehicle damage;

5. economic loss;

6. loss of income;

7. loss of profits;

8. business interruption;

9. loss of opportunity;

10. towing costs;

11. hire vehicle costs;

12. accommodation;

13. travel costs;

14. labour costs;

15. diagnostic costs;

16. removal or refitting costs;

17. third-party claims;

18. indirect, incidental, special, punitive, exemplary, or consequential loss,

arising from or connected with the Product, except to the extent liability cannot lawfully be excluded.

Where liability cannot be excluded but can be limited, LPSR Lucas Power Steering Racks liability is limited to the maximum extent permitted by law to the purchase price paid for the specific Product giving rise to the claim, or the repair or replacement of that Product.

 

23. No Liability for Installation or Third Parties

LPSR Lucas Power Steering Racks is not responsible for the acts, omissions, advice, workmanship, errors, negligence, or representations of:

1. mechanics;

2. installers;

3. workshops;

4. engineers;

5. freight providers;

6. resellers;

7. distributors;

8. vehicle inspectors;

9. certifiers;

10. third-party repairers;

11. any person not directly employed by LPSR Lucas Power Steering Racks.

No third party is authorised to bind LPSR Lucas Power Steering Racks unless LPSR Lucas Power Steering Racks confirms this in writing.

 

24. Customer Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless LPSR Lucas Power Steering Racks from and against all claims, losses, damages, liabilities, costs, expenses, penalties, demands, proceedings, and legal costs on a full indemnity basis arising from or connected with:

1. your breach of these Terms;

2. incorrect installation;

3. DIY installation;

4. misuse of a Product;

5. vehicle modification;

6. failure to inspect, maintain, or stop using the Vehicle after symptoms;

7. incorrect product selection based on information supplied by you;

8. resale or transfer of the Product;

9. injury, death, or property damage caused or contributed to by your act, omission,

negligence, or breach;

10. claims by third parties arising from your installation, use, resale, or transfer of the

Product.

 

This indemnity survives completion of the sale, expiry of warranty, resale of the Product, and termination of any relationship between you and LPSR Lucas Power Steering Racks.

 

25. Resellers, Workshops and Trade Customers

If you are a reseller, mechanic, workshop, distributor, or trade customer, you agree that you must:

1. provide these Terms to the end user before sale or installation;

2. ensure the end user is warned that the Product is safety-critical;

3. ensure installation is performed only by a Qualified Installer;

4. not make representations beyond those expressly authorised by LPSR Lucas Power Steering Racks;

5. not alter, remove, conceal, or contradict LPSR Lucas Power Steering Racks warnings;

6. maintain records of installation and end-user supply;

7. indemnify LPSR Lucas Power Steering Racks for claims arising from your resale, advice, workmanship, installation, omission, or failure to pass on warnings.

Trade customers must not represent themselves as agents of LPSR Lucas Power Steering Racks unless expressly authorised in writing.

 

26. No Unauthorised Representations

No employee, contractor, reseller, distributor, installer, mechanic, agent, or representative has authority to make any promise, warranty, guarantee, admission, or representation on behalf of LPSR Lucas Power Steering Racks unless confirmed in writing by an authorised director of LPSR Lucas Power Steering Racks.

Any statement not expressly included in these Terms is excluded to the maximum extent

permitted by law.

Marketing statements, website content, photos, videos, product descriptions, compatibility information, estimates, or informal communications are general only and do not override these Terms.

 

27. Technical Advice Disclaimer

Any technical guidance provided by LPSR Lucas Power Steering Racks is general assistance only.

It does not replace:

1. professional mechanical diagnosis;

2. inspection of the Vehicle;

3. installer judgment;

4. manufacturer service information;

5. engineering certification;

6. roadworthiness requirements;

7. applicable laws or standards.

You must not rely solely on LPSR Lucas Power Steering Racks’ general comments when determining whether a Vehicle is safe to drive.

 

28. Product Images and Descriptions

Product images, diagrams, website descriptions, compatibility references, and technical summaries are provided for general identification only.

Actual Products may vary due to:

1. reconditioning processes;

2. supplier changes;

3. manufacturer variations;

4. superseded parts;

5. minor design differences;

6. vehicle-specific variations.

You must confirm suitability before installation.

 

29. Reconditioned and Exchange Products

Some Products may be reconditioned, remanufactured, refurbished, exchange-based, or rebuilt.

You acknowledge that reconditioned Products may contain used core components that have been inspected, repaired, replaced, or reconditioned as considered appropriate by LPSR Lucas Power Steering Racks.

A reconditioned Product is not represented as a brand-new OEM product unless expressly stated in writing.

 

30. No Suitability for Modified or Non-Standard Vehicles Unless Confirmed

Unless LPSR Lucas Power Steering Racks expressly confirms in writing, Products are supplied for standard vehicles used under ordinary road conditions.

If your Vehicle has been modified, lowered, lifted, converted, imported, repaired after

accident damage, used for racing, fitted with non-standard wheels or tyres, or altered from factory specification, you must obtain professional advice before purchase and installation.

LPSR Lucas Power Steering Racks is not responsible for failure or incompatibility arising from non-standard vehicle condition or use.

 

31. International Customers

If you purchase from outside Australia, you are responsible for ensuring that the Product

complies with all laws, regulations, roadworthiness rules, customs rules, certification

requirements, consumer laws, product safety laws, and vehicle standards in your jurisdiction.

LPSR Lucas Power Steering Racks does not represent that any Product is approved for use in every country.

International customers are solely responsible for:

1. import duties;

2. taxes;

3. customs clearance;

4. local certification;

5. engineering approval;

6. roadworthiness compliance;

7. installation compliance;

8. local consumer or product safety obligations where applicable.

To the maximum extent permitted by law, all disputes are governed by the law of Western

Australia.

 

32. European Union and Other Overseas Customers

Where Products are supplied to customers in the European Union, United Kingdom, New Zealand, or any other jurisdiction, mandatory local laws may apply.

Nothing in these Terms excludes liability that cannot be excluded under mandatory local law.

However, to the maximum extent legally permitted:

1. LPSR Lucas Power Steering Racks does not accept additional liability beyond mandatory law;

2. LPSR Lucas Power Steering Racks does not appoint overseas installers, workshops, agents, or certifiers;

3. LPSR Lucas Power Steering Racks does not warrant compliance with overseas vehicle approval regimes unless expressly stated in writing;

4. the Customer remains responsible for local legal compliance, installation approval,

and roadworthiness.

If local law requires a different mandatory remedy, that mandatory remedy applies only to the extent legally required.

 

33. Online Orders, Checkout and Electronic Acceptance

By placing an order through LPSR Lucas Power Steering Racks’ website, email, invoice, phone, social media, Ebay, marketplace listing, or other sales channel, you agree that:

1. these Terms apply to the transaction;

2. checkout acceptance, payment, order confirmation, receipt of goods, installation, or

use constitutes acceptance;

3. electronic acceptance is binding;

4. any terms proposed by you are rejected unless expressly accepted in writing by

LPSR Lucas Power Steering Racks;

5. these Terms prevail over inconsistent purchase order terms, workshop terms,

customer terms, or reseller terms.

 

34. Payment, Pricing and Order Acceptance

All prices are subject to change without notice.

LPSR Lucas Power Steering Racks may refuse, cancel, or refund any order before dispatch for any reason, including:

1. pricing error;

2. stock unavailability;

3. suspected fraud;

4. incorrect product selection;

5. delivery restrictions;

6. compliance concerns;

7. safety concerns.

An order is not accepted until LPSR Lucas Power Steering Racks confirms acceptance or dispatches the Product.

 

35. Cancellation and Returns

Returns are accepted only where required by law or expressly approved by LPSR Lucas Power Steering Racks in writing.

Subject to the ACL:

1. change-of-mind returns are not automatically accepted;

2. Products that have been installed, attempted to be installed, modified, contaminated, damaged, used, or removed from sealed packaging may not be returnable;

3. special-order, custom, reconditioned, exchange, or vehicle-specific Products may not be cancellable once processing has commenced;

4. approved returns must be in original condition and packaging;

5. restocking fees may apply where permitted by law;

6. freight costs are generally non-refundable unless required by law.

 

36. Evidence and Burden of Proof

To the maximum extent permitted by law, any Customer making a claim must provide

sufficient evidence to establish:

1. the Product was defective at the time of supply;

2. the defect was not caused by installation error, vehicle condition, contamination,

misuse, modification, lack of maintenance, or external cause;

3. all installation, certification, maintenance, and use requirements were complied with.

LPSR Lucas Power Steering Racks may reject claims unsupported by adequate records, evidence, or returned Product inspection.

 

37. Preservation of Evidence

If a fault, incident, accident, or alleged failure occurs, you must:

1. stop using the Vehicle immediately;

2. preserve the Product;

3. preserve related components;

4. preserve fluid samples where possible;

5. preserve installation records;

6. preserve photographs and videos;

7. not repair, alter, dismantle, discard, or destroy evidence without notifying LPSR Lucas Power Steering Racks;

8. allow LPSR Lucas Power Steering Racks reasonable opportunity to inspect.

Failure to preserve evidence may prejudice or defeat any claim to the maximum extent

permitted by law.

 

38. Recalls, Safety Notices and Product Updates

If LPSR Lucas Power Steering Racks issues a safety notice, recall, inspection request, or product update, you must comply promptly.

You must ensure that any subsequent purchaser, owner, mechanic, or user of the Vehicle is informed of any safety notice affecting the Product.

Failure to comply with a recall or safety notice may void warranty rights and transfer resulting risk to you to the maximum extent permitted by law.

 

39. Force Majeure

LPSR Lucas Power Steering Racks is not liable for delay, non-performance, or failure caused by matters beyond its reasonable control, including:

1. natural disasters;

2. fire;

3. flood;

4. pandemic;

5. war;

6. strikes;

7. transport disruption;

8. supplier failure;

9. customs delays;

10. government action;

11. power failure;

12. cyber incident;

13. material shortages;

14. carrier delays.

 

40. Privacy and Customer Information

LPSR Lucas Power Steering Racks may collect, use, and store customer information for order processing, warranty assessment, safety notices, recalls, fraud prevention, compliance, customer service, and business administration.

Customers must provide accurate contact and vehicle information.

Failure to provide accurate information may affect delivery, warranty processing, safety

notices, and support.

 

41. Intellectual Property

All website content, product descriptions, images, manuals, diagrams, videos, documents, branding, logos, and technical materials remain the intellectual property of LPSR Lucas Power Steering Racks or its licensors.

You must not copy, reproduce, modify, distribute, or commercially exploit LPSR Lucas Power Steering Racks materials without written permission.

 

42. Severability

If any provision of these Terms is invalid, unlawful, or unenforceable, that provision is

severed to the minimum extent necessary and the remaining provisions continue in full force.

 

43. No Waiver

Failure by LPSR Lucas Power Steering Racks to enforce any provision of these Terms does not constitute waiver of that provision.

 

Any waiver must be express and in writing.

 

44. Entire Agreement

These Terms, together with any invoice, written quotation, product-specific written

instruction, and mandatory law, constitute the entire agreement between LPSR Lucas Power Steering Racks and the Customer regarding the Product.

These Terms supersede all prior discussions, statements, representations, advertisements, website content, correspondence, or understandings to the extent permitted by law.

 

45. Changes to Terms

LPSR Lucas Power Steering Racks may update these Terms from time to time.

The Terms applicable to your purchase are the Terms in force at the time of order, unless a later version is required by law or expressly accepted by you.

Continued use of LPSR Lucas Power Steering Racks’ website or Products after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by law.

 

46. Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia.

Subject to any mandatory law that provides otherwise, the parties submit to the non-

exclusive jurisdiction of the courts of Western Australia and courts competent to hear

appeals from those courts.

Where the Customer is located outside Australia, the Customer agrees that Western

Australia is the most appropriate forum for any dispute to the maximum extent permitted by law.

 

47. Mandatory Customer Acknowledgement

By purchasing, ordering, accepting delivery, installing, fitting, using, reselling, transferring, or allowing another person to use any LPSR Lucas Power Steering Racks Product, you expressly acknowledge and agree that:

1. the Product is a safety-critical steering component;

2. incorrect installation or misuse may cause serious injury or death;

3. installation must be performed only by a Qualified Installer;

4. the Vehicle must be inspected and certified before road use;

5. you must retain installation, certification, and maintenance records;

6. warranty is limited and conditional;

7. LPSR Lucas Power Steering Racks’ liability is limited to the maximum extent permitted by law;

8. you must stop using the Vehicle immediately if steering symptoms arise;

9. you are responsible for vehicle compatibility, installation, maintenance, and lawful

use;

10. you have read, understood, and accepted these Terms.
